Terms of Service

By creating an account or using SavvyREI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Eligibility: You must be at least 18 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Agreement: These Terms constitute a legally binding agreement between you and SavvyREI LLC. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

SavvyREI is a lead management platform designed for real estate investors. The Service provides tools to help you manage and communicate with property owner leads.

Features Include

• Lead import and management
• SMS and email communication
• Voice calling with AI assistance
• Deal pipeline tracking
• AI-powered message drafting
• Calendar and scheduling integration
• Team collaboration tools

Service Availability

We make reasonable efforts to ensure the Service is available 24/7. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

To use the Service, you must create an account and provide accurate, complete information.

Your Responsibilities

• Accurate Information: You must provide truthful and accurate information during registration and keep it updated.
• One Account Per Person: Each individual may have only one account. Team members should be added via invitation, not separate accounts.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• Unauthorized Access: You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

SavvyREI offers several subscription plans to meet different business needs. Current pricing is as follows:

Unlimited Features: AI message drafts and human voice calls are unlimited on Solo and Team plans.

Billing Terms

• Billing Cycle: Subscriptions are billed monthly on the anniversary of your signup date.
• Payment Methods: We accept credit and debit cards via Stripe. All payments are processed securely.
• Failed Payments: If a payment fails, we will retry up to 3 times. After failed retries, your account may be suspended.
• Price Changes: We will provide at least 30 days notice before any price changes affect existing subscribers.

We want you to be satisfied with our Service. Our refund policy is designed to be fair while preventing abuse.

Automatic Approval

Refund requests are automatically approved if all of the following criteria are met:

• Request is made within 7 days of the charge
• Amount is $49 or less
• This is your first refund request
• No significant platform usage has occurred

Manual Review Required

Refund requests require manual review if:

• Request exceeds the 7-day window
• Amount exceeds $49
• You have previously received a refund
• Significant platform usage has been detected

Processing

Approved refunds are processed to your original payment method within 5-10 business days.

Non-Refundable Items

Add-on purchases (additional leads, SMS, or voice minutes) are non-refundable after usage has begun.

New accounts receive a 7-day activation period to explore the platform.

Trial Includes

• 250 leads included
• Full access to lead management features
• No SMS or Voice AI minutes included
• No credit card required to start

After Trial Expiration

If you do not subscribe after the trial period, your data will be retained for 30 days in a read-only state. After 30 days, your data will be permanently deleted unless you subscribe to a paid plan.

Cancellation by You

• You may cancel your subscription at any time via Settings > Billing.
• Access continues until the end of your current billing period.
• After cancellation, your account enters a 30-day read-only period.
• Data is permanently deleted after the 30-day period unless you resubscribe.

Termination by Us

• Violation of Terms: We may terminate your account immediately for violations of these Terms.
• Non-Payment: Accounts may be suspended after failed payment retries.
• Abuse or Spam: Accounts engaging in spam or abuse may be restricted or terminated.
• At Our Discretion: We may terminate accounts with 30 days notice for any reason.

Account Deletion

You may request account deletion via Settings or by contacting support. There is a 14-day grace period during which you can cancel the deletion request. After the grace period, deletion is permanent and irreversible.

You May

• Use the Service for legitimate real estate investment business purposes
• Import leads from legal sources
• Send manual person-to-person communications
• Store business-related files and documents

You May Not

• Send spam or unsolicited bulk messages
• Harass, threaten, or abuse leads or other users
• Use the Service for illegal purposes
• Violate TCPA, CAN-SPAM, or other applicable regulations
• Share your account credentials with others
• Reverse engineer, scrape, or attempt to extract data from the platform
• Resell access to the Service without authorization
• Interfere with or disrupt the Service or its infrastructure

Manual P2P Messaging Model

SavvyREI enables manual person-to-person (P2P) messaging. All messages are manually initiated by users—no automated messages are ever sent without explicit user action.

• Per Facebook v. Duguid (2021), manual texting from stored contact lists is NOT considered an autodialer under TCPA.
• TCPA autodialer consent requirements do not apply to manual P2P messaging.
• Users must still respect opt-out requests (e.g., "STOP").

Do Not Contact (DNC)

• We honor all opt-out requests immediately.
• Leads marked as Do Not Contact cannot be messaged.
• Re-engagement is only permitted if the lead initiates contact.

Spam Protection

• Per-Lead Cap: After 4 unanswered messages to a single lead, you will be blocked from messaging that lead until they reply.
• Account Flagging: Pattern abuse (hitting caps on multiple leads) may result in account flagging.
• Messaging Restrictions: Repeat offenders may have messaging privileges restricted or revoked.

Your Responsibility

You are responsible for complying with all applicable laws and regulations regarding communications. We provide tools, not legal advice. We are not liable for your compliance failures.

Calls made through the Service may be recorded for quality assurance and training purposes.

• One-Party Consent: Ohio is a one-party consent state, meaning only one party to a conversation needs to consent to recording.
• Recording Disclosure: A disclosure is played at the start of recorded calls to inform all parties.
• Retention: Call recordings are retained for 365 days, after which they are automatically deleted.
• Your Responsibility: If you operate in states with two-party consent requirements, you are responsible for ensuring compliance with those laws.

AI Message Drafts

• AI generates suggested message text based on conversation context.
• You must review and approve all AI-generated content before sending.
• AI never sends messages automatically—all sends require your action.
• AI message drafts are unlimited on all plans.

AI Voice (Future Feature)

• AI may answer inbound calls on your behalf (when enabled).
• AI will disclose its nature at the start of each call.
• Voice AI minutes are tracked and billed according to your plan.

No Autonomous Actions

AI features are designed to assist, not replace, your decision-making:

• AI does not contact leads without your explicit action.
• AI does not make business decisions on your behalf.
• You are responsible for all communications sent through the platform.

Our Property

The following are owned by SavvyREI LLC:

• The SavvyREI name, logo, and branding
• Platform software, code, and design
• Documentation and training materials
• All proprietary algorithms and processes

Your Property

You retain ownership of:

• Your lead data and contact information
• Your message templates and custom content
• Your uploaded files and documents

License to Us

By using the Service, you grant us a limited license to process your data solely to provide the Service. We do not claim ownership of your content. We may use anonymized, aggregated data to improve our services.

The Service integrates with third-party services to provide enhanced functionality:

• Email Integration: Gmail and Outlook integration via Aurinko for email sync.
• Calendar Integration: External calendar connections for scheduling.
• Payment Processing: Stripe for secure payment handling.

Your Authorization

When you connect a third-party service, you authorize us to access and share data as necessary for the integration to function. Third-party services are governed by their own terms and privacy policies.

Disclaimer

We are not responsible for the availability, accuracy, or security of third-party services. Issues with third-party integrations should be directed to the respective service provider.

"AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free service
• Accuracy or completeness of data

Not Legal Advice

SavvyREI provides tools for lead management, not legal advice. We do not provide guidance on compliance with TCPA, CAN-SPAM, or other regulations. Consult a qualified attorney for legal questions. We are not responsible for your legal compliance.

Lead Data Accuracy

You are responsible for the accuracy of lead data you import. We do not verify lead information. Public records and third-party data sources may be outdated or inaccurate.

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

• The fees you paid to us in the 12 months preceding the claim, or
• $500 USD

Exclusions

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Lost profits or revenue
• Loss of data or data breaches
• Business interruption
• Loss of goodwill or reputation
• Actions or omissions of third parties

Exceptions

These limitations do not apply where prohibited by applicable law, or in cases of gross negligence or willful misconduct by SavvyREI.

You agree to indemnify, defend, and hold harmless SavvyREI LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your messaging or communication practices
• Claims by leads, property owners, or other third parties
• Your use or misuse of the Service
• Your content or data uploaded to the Service

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Columbus, Ohio, or virtually at the parties' agreement.

Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.

Exceptions

• Small claims court for qualifying disputes
• Injunctive relief for intellectual property violations

We may modify these Terms at any time. When we make changes:

• Material Changes: We will provide at least 30 days notice via email to your registered email address.
• Notice: We may also display a notice within the application for significant updates.
• Effective Date: The "Last updated" date at the top of this page will be revised.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must cancel your subscription before the effective date.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SavvyREI regarding the Service.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
• Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
• Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
